The Chair, Councillor Mark James, declared a personal interest as an employee of Transport for London in relation to the items on the agenda, commenting that the organisation had commented on the planning applications.

The Planning Board is requested to consider a Section 73 Variation application in respect of planning permission reference 13/0117/O being an Outline Planning Permission for mixed use development comprising 2,032 units and 2,442 (GEA) sqm of non-residential floor space (A1/A2/A3/A4/B1/D1 Use), access, landscaping, public accessible open space, car and cycle parking provision and refuse and recycling storage areas.

That application for Section 73 Variation be granted in respect of planning permission reference 13/0117/O being an Outline Planning Permission for mixed use development comprising 2,032 units and 2,442 (GEA) sqm of non-residential floor space (A1/A2/A3/A4/B1/D1 Use), access, landscaping, public accessible open space, car and cycle parking provision and refuse and recycling storage areas.  The amendment sought would vary Condition 01 of 13/0117/O, which lists the approved drawing numbers, to provide for changes in the approved scheme to Plot A

 

Subject to:

 

(i)        The satisfactory completion of a Section 106 (S106) Legal Agreement (obligations set out in Section 8 of the report);

 

(ii)      Conditions set out in Appendix 2 of the main report, and

 

(iii)     amendments and informatives set out the Addendum report tabled at the meeting, with the exclusion of requirement relating to Section 278 Legal Agreement which does not constitute matters for planning consideration.

The Chair, Councillor Mark James, had declared a personal interest as an employee of Transport for London in relation to this Item.

 

The Senior Planning Officer gave an illustrative presented to the report, recommending to the Board to approve the proposal therein.  It was stated that an Addendum Report in relation to the application was circulated at the meeting.

 

The Board noted the report and the addendum to it.  It was recognised that the proposal was for a Section 73 Variation to Condition 01 of an Outline Planning Permission (reference 13/0117/O) that was granted for a mixed-use development.

 

In addressing the meeting, the agent for the applicant questioned the relevancy of completing a Section 278 Legal Agreement in regard to planning matters.  The Board sought clarification on the issue, and was advised by the Area Planning Manager (Major Developments) that Section 106 Legal Agreements were sufficient.

 

In respond to a question, the agent for the applicant advised the Board that in determining the detailed design of the proposed development, the Environment Agency and Flood Protection Agency raised concerns on aspects of the application.  It was stated that in addressing the applicant decided to relocate the car park to its current position at a higher level above ground as outlined in the drawing plans, in order to enhance flood protection on the application site.

 

In considering submissions made at the meeting, Members welcomed the decision by the applicant to relocate the car park from its original position, commenting that flood protection along the riverfront was a necessity.  Members also expressed a satisfaction that the application was in compliant with the relevant planning rules and guidelines, in particular that the proposal would ensure a satisfactory completion of a Section 106 Legal Agreement.

 

The Board voted on the proposal and

The Planning Board is requested to consider the submission of Reserved Matters (Appearance, Landscaping, Layout and Scale), pursuant to condition 2 of Outline Planning Permission (Ref: 13/0117/O dated 19.06.13 for 764 residential units and 602 (GEA) sqm of non-residential floorspace within the A Blocks (Phases 9/10/11/12/13/14) and revised landscaping details for the northern part of the Waterfront Park.
