In reaching its decision the Sub Committee considered the Council’s statement of Licensing Policy, the Licensing Act 2003, the Regulations made there under and the Guidance issued by the Secretary of State under S.182 of that Act. In discharging its functions, the Sub Committee did so with a view to promoting the licensing objectives of the prevention of crime and disorder, public safety, the prevention of public nuisance and the protection of children from harm.

 

Having considered all the evidence put before it the Sub-Committee decided to grant the Time-Limited Premises Licence under the Licensing Act 2003 in respect of the

The licence is granted subject to the conditions as are consistent with the Operating Schedule and the conditions volunteered by the Applicant as set out below:

 

1        The event shall be run in accordance with the latest version of the     organiser’s Event Safety Management Plan (ESMP), as approved by    members of the Royal Borough of Greenwich Council’s Entertainment   Licensing Safety Advisor Group (ELSAG), comprised of representatives      from the Licensing Authority, the Responsible Authorities, and other           relevant bodies.

 

2        The ESMP shall include the following “Challenge 25”/“Think 25” proof-       of-age scheme conditions relating to the sale & supply of alcohol and the      relevant licensing objective/s:

 

·        All stall holders selling alcohol at the event must adhere to the “Challenge 25”/“Think 25” scheme. A log shall be kept of such training for inspection by Police and suitably authorised Council Officers.

 

·        The “Challenge 25” scheme shall operate at all times. All staff shall be trained to accept only forms of identity bearing a photograph of the holder – such as passport, photo driving licence or ‘PASS’ cards – when selling alcohol to young people. If the person seeking alcohol is unable to produce an acceptable form of ID, no sale or supply of alcohol shall be made to or for that person.

 

·        The following shall be displayed conspicuously on all stalls selling or otherwise supplying alcohol:

 

a)    “Think 25” (or similar) poster to advise potential purchasers that suitable proof of age will be required for all purchasers who appear to be under 25;

 

                   b) “Don’t Buy Alcohol for Under 18’s”, “It’s A Crime!” or similar                 proxy sales posters intended to warn adults not to buy alcohol for              those under 18 years-of-age.

 

3        All drinks supplied on the event site shall be strictly served in plastic disposable cups only.

 

4        The ESMP shall include procedures to allow for the access and egress of      fire appliances/emergency vehicles on site.

The Licensing officer gave an illustrated presentation of the report confirming there was no amendments.

 

In response to questions the licensing officer stated that to there had been no complaints received against the similar events held by the applicant at the location. He also provided a response to the planning concerns raised by the objector confirming that, so far this year, events had only been held for 8 days at the location which is less than the 28 days needed before a formal change of use application is required.

 

The Sub Committee was address by the applicant who confirmed that the conditions on the application were the same as for the previous events and that the stage would be smaller this year. She added that there would be no live bands and only Woolwich carol singers and jazz musicians who would not be using drums. She continued that there would be staff managing the noise levels by the façade of the buildings to ensure there is no disturbance to local residents.

 

The applicant confirmed that they had addressed the concerns raised at the Entertainment Licensing Safety Advisory Group meeting by adding barriers to prevent access to certain areas and ensuring all staff had the relevant training. They also stated that information regarding the event was provided to the local residents and there would only be one bar serving festive drinks.

 

The Chair noted that the Committee had read the objections raised by the local resident and stated they would be considered when the Committee made its decision.

 

In response to a question, the legal advisor confirmed that if the Sub Committee were in agreement and ready to make their decision there was no requirement to ask all parties to leave.

 

The Chair informed those present of the decision of the Sub-Committee, and stated that the full details would be given in the formal decision notice within 5 working days.
